TTL Files Complaint to Claim ฿6.45bn from RATCH for Infringing Trade Secret of Hongsa Power Plant Project in Laos.


RATCH Group Public Company Limited (RATCH) had stated that the company obtained a summons and a copy of a complaint of the Central Intellectual Property and International Trade Court regarding a civil lawsuit filed by Thai-Lao Lignite Company Limited (TLL) as a plaintiff.

Thai-Lao Lignite alleged that RATCH has infringed upon its trade secrets when running Hongsa Power Plant Project in Hongsa District, Lao People’s Democratic Republic, whereby the claim amount in the complaint is 6,457,097,500 baht.

RATCH had authorized the lawyer to proceed with the legal defense for RATCH, and had submitted the answer to the complaint. On August 30, 2019, the Court had scheduled a pre-trial hearing for case management and oral opening statements.

RATCH was convinced that it did not commit the actions as alleged in the complaint and RATCH was highly confident in its legal defense. Therefore, the company had not yet recorded any contingent liabilities in its accounts.

In order to protect its rights as provided by law, RATCH shall proceed with the litigation defense in accordance with the judicial and legal procedure.

 

RATCH holds 40% stake in Hongsa project through its subsidiary while BANPU Public Company Limited (BANPU) holds 40%, and Laos’ state enterprise holds 20% of the project.
