AOT’s “Nitinai” Clarifies the Disqualification of MINT, Reiterating Condition of TOR!

Mr. Nitinai Sirismatthakarn had made further clarification through his Facebook account, reiterating that MINT failed to submit Minor Food as a JV.


Following the dispute between Airports of Thailand Public Company Limited (AOT) and Minor International Public Company Limited (MINT) over the decision making of Suvarnabhumi commercial area concession that MINT claimed of receiving an unjust qualification process by AOT, Mr. Nitinai Sirismatthakarn, President of AOT, had made further clarification through his Facebook account “Nitinai Sirismatthakarn” as follows:

Clarification on disqualification of Minor International Public Company Limited (MINT) for the bidding of Suvarnabhumi commercial area.

1) Facts
1.1) The entity who purchased the bidding envelope was MINT (Minor International) which was a holding company without any working experience while having a subsidiary as Minor Food who actually had working experience. In the past, Minor Food was the one who participated in the bidding for Don Mueang Airport commercial area and Phuket Airport commercial area.
1.2) AOT allowed the bidder to submit the list of joint venture company and consortium within May 22, 2019, which already passed the expiration date and MINT did not submit the list to AOT.

2) Clarification
2.1) AOT did not deny the fact in the statement announced by MINT saying that Minor Food was under the management of MINT. However, the TOR had stated clearly that only the entity who purchases the bidding envelope was eligible to submit the form. If MINT would like to submit the working experience of Minor Food, the company could have had Minor Food purchase the envelope just like what it had been done in the past.
2.2) If MINT would like to submit the working experience of Minor Food, it could be done by submitting Minor Food as a joint venture by May 22, 2019, but MINT failed to do so.
2.3) If MINT proceed according to 2.1 or 2.2, it would have passed the qualification process, but submitting another entity that was not the one who purchased the envelope was against the TOR.
