Arbitration Dismisses TOT’s Petition, Indicating AIS Did Not Breach Agreement

On February 21, 2019, the Arbitration had dismissed TOT's petition on breaching concession agreement.


Advanced Info Service Public Company Limited (ADVANC) or AIS has announced a reference to the dispute that TOT Public Company Limited (TOT) had filed to the Arbitration back in 2014 against AIS, requesting AIS to suspend the porting out of subscribers to Advanced Wireless Network Company Limited (AWN), a 99.99% subsidiary.

TOT claimed that this breached concession agreement between AIS and TOT, and claimed for the damages in the amount of THB 32,813 million with interest rate of 7.5 per annum.

On February 21, 2019, the Arbitration had unanimously resolved the dispute in favor of AIS to dismiss TOT’s claim, with the consideration that AIS did not breach the agreement.

However, TOT is eligible to file a petition to the Central Administrative Court to revoke the Arbitration’s resolution within 90 days from the date of receiving such resolution.
