“DTAC’s Trump Card” Is Beyond Anyone’s Imagination!

It is unbelievable that DTAC would use the filing complaint technique against NBTC. This is all to “protect” its subscribers.


The surprise move made by Total Access Communication Public Company Limited (DTAC) has stunned the National Broadcasting and Telecommunications Commission (NBTC) when DTAC files a complaint with Administrative Court against NBTC for not approving the protection of DTAC subscribers’ right to continuously use the 850MHz network after the end of its concession on September 15, 2018.

 

Rajiv Bava”, chief corporate affairs & business development officer of DTAC said that the complaint with Administrative Court against NBTC is due to the subscribers’ right to continuously use the 850MHz network until NBTC takes the network to the auction.

No one has seen this coming from DTAC. This trump card is so flashy that it blinds everyone.

 

In fact, the relationship between DTAC and NBTC is not complicated as it seems to be. The conditions requested by DTAC were often raised during the meeting and even off the meeting. Some says that part of NBTC boards also agree with DTAC’s conditions, but the problem is “how are they going the give a clear explanation to the public, if they bend for DTAC

It is understandable for DTAC that this method is a “must”. The complaint to the Administrative Court is not to take an advantage on NBTC, but to protect its benefits as much as possible.

 

The court’s decision is yet to be announced, but there are likely to be within these three scenarios.

  1. The court denies the complaint.
  2. The court accepts the complaint and declare temporary protection for DTAC’s subscribers until further decision is made.
  3. The court accepts the complaint, but denies temporary protection for DTAC’s subscribers.

 

It is crystal clear that DTAC would want the second scenario to nullify the August 18, 2018 NBTC’s resolution, as well as the upcoming NBTC Board of Directors meeting on September 12, 2018.

Let’s keep a close eye on how NBTC will par with DTAC in the court. How will NBTC file against DTAC’s complaint and on what reason? Further progress will depend on the legal procedures.

 

DTAC’s short-term investors and shareholders will have to wait and see the court’s decision. The shares price may get a (short) sudden jump, if the court rules in DTAC’s favor.

On the other hand, if the decision falls on the first or third scenario, farewell…..
